1. Who we are

SignalCartel (“we”, “us”, “our”) is operated by Mind Money Movement (Pty) Ltd, a South African private company (registration number 2024/350331/07). These Terms of Service (“Terms”) govern your access to and use of the website at signalcartel.tradeand all related services (collectively, the “Service”).

2. Acceptance of these Terms

By creating an account, subscribing to a paid plan, or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree, do not use the Service.

3. Eligibility

You may use the Service only if you:

• are at least 18 years old and have the legal capacity to enter into a contract;
• are not a resident of, or located in, a jurisdiction where the use of trading signals or related services is prohibited by law;
• are not subject to any sanctions list maintained by the South African government, the United Nations, the European Union, the United Kingdom, or the United States; and
• provide truthful, current, and complete information when creating your account.

4. Account and security

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at support@signalcartel.trade if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe to be compromised.

5. Subscriptions, billing, and renewals

5.1 Plans

We offer Starter (per-strategy) and Pro (all-strategies) subscription plans, billed monthly or annually in U.S. dollars (USD). Current pricing is shown at /pricingand may change with notice as described in Section 14.

5.2 Automatic renewal

All paid subscriptions automatically renew at the end of each billing period (monthly or annual) and charge your PayPal-linked payment method at the then-current price for the same plan. By subscribing, you authorize us and PayPal to charge your payment method on each renewal until you cancel.

5.3 Cancellation

You may cancel auto-renewal at any time by following the PayPal-hosted “Manage subscription” link on your /account/subscriptions page. Cancellation stops future renewals; you retain access to paid channels for the remainder of the current billing period, after which your Telegram channel access is revoked automatically.

5.4 Failed payments

If a renewal payment fails, PayPal will attempt to retry per its standard recovery flow. After repeated failures, your subscription will move to a “past due” or “expired” state and your channel access will be revoked. You can re-subscribe at any time.

5.5 Taxes

Prices shown exclude any sales tax, VAT, GST, or similar tax that may apply in your jurisdiction. Where required by law, applicable taxes will be added at checkout or charged separately. You are responsible for any taxes assessed on your subscription.

5.6 Refunds

Our refund policy is set out in our separate Refund Policy. In summary: you may request a full refund within seven (7) days of your first payment for a given plan. Renewals and payments after the first seven days are non-refundable.

6. Telegram channel access

Active paid subscribers receive a one-time invite link to one or more private Telegram channels corresponding to the strategies in their plan. Joining the channel(s) requires you to have a Telegram account and to share your Telegram user identifier with us for the purpose of managing channel membership. We may revoke your channel membership at any time if your subscription becomes inactive, if you violate these Terms, or if we reasonably determine that you are abusing the Service.

7. Acceptable use

You agree not to:

• forward, republish, resell, mirror, or otherwise redistribute signals or any other content received via the Service to third parties;
• use the Service to provide trading advice or signal-distribution services to your own customers without our prior written permission;
• scrape, mirror, or otherwise programmatically access the Service except via the interfaces we expressly provide;
• attempt to reverse engineer, decompile, or extract the underlying models, parameters, or strategy logic of the Service;
• circumvent any access control, gating, or anti-abuse mechanism;
• use the Service in any way that violates applicable laws or the rights of third parties.

Violation of this Section may result in immediate suspension or termination of your account, with no refund beyond what is provided in our Refund Policy.

8. Intellectual property

All content on the Service — including signals, performance data, backtest reports, website copy, design, code, and trademarks — is the property of Mind Money Movement (Pty) Ltd or our licensors and is protected by South African and international intellectual property laws. Subscribers receive a limited, non-exclusive, non-transferable, revocable licence to view and use signals solely for their own personal trading decisions during their active subscription period.

The Service is provided “as is” and “as available”, without warranty of any kind, whether express, implied, or statutory, including without limitation any warranty of merchantability, fitness for a particular purpose, accuracy, profitability, non-infringement, or uninterrupted availability. We do not warrant that the Service will be error-free, that defects will be corrected, or that the Service will meet your requirements or expectations.

12. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Mind Money Movement (Pty) Ltd, its directors, employees, contractors, affiliates, or licensors be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost trading gains, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the greater of (a) the total fees you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD 100). Some jurisdictions do not allow the exclusion or limitation of certain damages, in which case such exclusions or limitations apply only to the extent permitted by law.

You agree to indemnify, defend, and hold harmless Mind Money Movement (Pty) Ltd and its directors, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any trading or investment decision you make based on information received via the Service.

14. Changes to the Service and these Terms

We may modify or discontinue any part of the Service at any time, with or without notice. We may also revise these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date, and where the change is material, we will notify active subscribers by email at least seven (7) days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, for any reason, including (without limitation) breach of these Terms. Upon termination, your right to use the Service ceases immediately, and any active subscription will be cancelled. Sections that by their nature should survive termination (including without limitation Sections 7–13 and 16) will survive.

16. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Western Cape Division of the High Court of South Africa. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

17. General

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms freely.
